COMPLYING DEVELOPMENT ORDER OF OPERATIONS
Phase 1: Pre-Lodgement
Section 10.7 Planning Certificate: Order this from Wingecarribee Shire Council. It will tell you if the land is bushfire-prone (BAL), flood-prone, or contains heritage items. If it’s "BAL-40" or "Flame Zone," you cannot use a CDC and must go through a full DA.
Site Survey & Architectural Plans: Engage a surveyor to mark boundaries and levels. Your plans must comply 100% with the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.
Specialist Reports: Depending on the 10.7 Certificate, you may need:
BAL Report (for bushfire areas).
Structural Engineering (Slab/frame designs).
Sydney Water "Tap In" Approval (to ensure you aren't building over a sewer main).
Waste Water Identification (Sewer, Septic or Envirocycle type)
Phase 2: Approval & Notification
All applications in the Southern Highlands must now go through the NSW Planning Portal.
Appoint a Certifier: You can use Council or a Private Certifier. You must also formally appoint them as the Principal Certifier (PC) via the Portal.
Lodge CDC Application: Upload all plans and reports to the Planning Portal.
Neighbour Notification: For CDCs, there is a mandatory notification period. The certifier will usually handle this, but you must wait 14 days after neighbours are notified before an approval can be issued (for certain types of work).
Pay Long Service Levy: If the work value is over $250,000, you must pay this levy before the CDC is released.
Warranty Insurance Policy: if the work is valued over $20,000 then a HCBF policy must be obtained for the value of the signed contract works
Phase 3: Pre-Construction
Notice of Commencement: You must notify Council and your neighbours at least 2 days before you start digging. This is done via the Planning Portal.
Site Setup: Install a sign with the Principal Certifier’s contact details and Marulan Carpentry's license info.
Set up sediment control (silt fences) and temporary fencing.
Phase 4: Construction & Inspections
Mandatory Inspection Points:
Excavation/Piers: Before pouring concrete.
Slab/Steel: Before the pour.
Frame: Once the carpentry is complete but before internal linings (plasterboard) go on.
Wet Areas: Waterproofing inspection for bathrooms/laundry.
Final Inspection: Once the job is finished.
Phase 5: Handover
Occupation Certificate (OC): Once the final inspection passes, the PC will issue an OC.
Note: You cannot legally occupy or use the structure until the OC is issued.
Final Documentation: Provide the owner with any termite protection certificates, glazing certificates, or waterproofing declarations.
